Defendant and previously sentenced co-conspirator shot and killed man in broad daylight
MINEOLA, N. Y. – District Attorney Madeline Singas announced today that a Hempstead man was found guilty in the murder of a 30-year old man in a 2018 Hempstead shooting that occurred in broad daylight.
Jamik Cannon, 28, of Hempstead, was convicted by a jury today of murder in the second degree (an A-I felony), assault in the first degree (a B felony), and two counts of criminal possession of a weapon in the second degree (a C violent felony). The defendant was remanded pending sentencing on July 15 and faces a maximum sentence of 50 years to life in prison. The trial, before Judge Robert Schwartz, started on May 3.
“The victim stood outside in the late-morning, talking to a friend, unaware of the defendants’ impending attack that would take his life,” said District Attorney Madeline Singas. “We hope that this conviction provides some measure of closure for the family and friends of Demetrius Winfield who continue to mourn after this senseless act of violence.”
DA Singas said that on October 19, 2018, at approximately 10:54 a.m., victim Demetrius Winfield, was with a friend on break from his job, in front of a home on Wellesley Street in Hempstead. Winfield and his friend were then allegedly shot by Cannon and his co-conspirator Brian Marshall-Gibson. Cannon and Marshall-Gibson fired at least 15 shots in 14 seconds.
Winfield was shot in the face, chest and groin and was pronounced dead shortly afterward at Winthrop Hospital. The second man was also shot and continues to recover from his injuries.
Cannon and Winfield were known to each other and had gotten into a disagreement three days earlier at a gas station.
Cannon and Marshall-Gibson were arrested by members of the Nassau County Police Department on December 11, 2018.
Marshall-Gibson pleaded guilty on April 29, 2020 to charges of murder in the second degree, attempted murder in the second degree, and criminal possession of a weapon in the second degree. He was sentenced on August 24, 2020 to a combined 20 years to life in prison and five years’ post-release supervision.
Senior Assistant District Attorney Michelle Lewisohn of DA Singas’ Major Offense Bureau and Assistant District Attorney Paula Cajdler of the County Court Trial Bureau prosecuted the Cannon and Marshall-Gibson cases. Cannon is represented by Dennis Lemke, Esq.
